Terms of use

Welcome to Whispery. These terms ("Terms") apply between you and Whispery ("we", "us") when you download or use the Whispery iPhone app (the "App"). By using the App you agree to these Terms. If you don't agree, please don't use the App.

Important: not a medical service

Whispery is a journaling companion, not a substitute for professional medical care, therapy, counseling, or crisis intervention. The reflections the AI generates are supportive in nature and do not constitute medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis or having thoughts of self-harm, please contact a mental health professional or call a crisis helpline immediately.

Who can use the App

You must be at least 13 years old (or the minimum digital-consent age in your country, if higher) to use the App. The App is provided for personal, non-commercial use only.

Relationship to Apple's standard EULA

The App is licensed to you under Apple's standard End User License Agreement (the "Apple EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement the Apple EULA for matters specific to Whispery (privacy, content, payments, refunds). For App-store and device-related matters the Apple EULA controls; for everything else, these Terms control. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Your content

You retain all rights to the audio you record and the transcripts derived from them (your "Content"). You grant us a limited, non-exclusive license to store, process, and display your Content solely so the App can function — for example, transcribing audio, generating empathic reflections, computing embeddings for the daily Capsule, and showing your timeline back to you.

We do not use your Content to train AI models. We do not share your Content with third parties for advertising or marketing.

Acceptable use

You agree not to use the App to:

• Record or store anyone else's voice without their consent
• Upload content you don't have the rights to
• Try to break, copy, or reverse-engineer the App
• Attack our servers or attempt to bypass security
• Trick the AI into generating harmful content

Free and Pro plans

The App is free to use within the monthly whisper limit (currently 25 whispers per calendar month). Pro is an optional paid subscription that unlocks unlimited whispers, longer recordings, and additional features. Pricing is shown inside the App and may change with notice.

Auto-renewal

The Pro subscription is an auto-renewing subscription. At the end of each billing period (monthly or yearly, your choice), it renews automatically for another period of the same length, charged to your Apple ID. Renewal happens unless you cancel at least 24 hours before the current period ends. Apple charges your Apple ID within 24 hours of the period ending.

You can cancel anytime from your iPhone's Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current period — you keep Pro features until then. There is no proration for cancelled time.

Refunds

We don't process payments directly and don't issue refunds. All refund requests must go through Apple per their published refund policy at support.apple.com/billing. Apple has sole discretion over refund decisions.

Service availability

We provide the App on an "as is" and "as available" basis. We try our best to keep the service running smoothly but do not promise uninterrupted availability. Maintenance, upstream provider outages, or your own connectivity may cause temporary disruptions.

Privacy

Your privacy is governed by our Privacy Policy, which is incorporated by reference into these Terms.

Account deletion

You can delete your account and all associated data at any time: Settings → Danger zone → Delete all my data. This is irreversible. After deletion, neither you nor we can recover any of your past whispers.

Limitation of liability

To the maximum extent permitted by law, Whispery and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the App. Our total cumulative liability for any claim relating to the App is limited to the amount you paid us in the 12 months preceding the claim (which, for free users, is zero).

Nothing in these Terms limits liability that cannot be limited under applicable law (such as gross negligence or willful misconduct).

Crisis & safety disclaimer

The App's crisis-detection feature is a best-effort signal based on AI inference. It may produce false positives or miss actual crisis content. It is not a replacement for emergency services. If you or someone you know is in immediate danger, call local emergency services right away.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and notify you in-app at the next launch. Continued use after changes means you accept the new Terms.

Governing law

These Terms are governed by the laws of Indonesia. Any disputes arising from the App or these Terms will be resolved in the competent courts of Jakarta, Indonesia, except where local consumer-protection law gives you a right to sue or be sued in your home jurisdiction.
